Conditions
About us
All travel and
holiday arrangements are made by Sailing Jollies acting as an agent
on behalf of yacht owners and operators. The trading name
Sailing Jollies has been registered in Gibraltar Number 09657
Registered address 9B The Square, Marina Bay, Gibraltar. Sailing
Jollies is owned by Pamela Drew who is trading as Sailing Jollies.
Sailing Jollies
logo are the intellectual property of Sailing Jollies and may
not be used copied or reproduced in any form without the specific
permission of Sailing Jollies.
- Sailing
Jollies has no connection whatsoever with any other trading name or
web site address which may appear similar.
- There are
risks attached to sailing and that Sailing Jollies cannot be held
responsible for any accident, injury loss or damage however caused
as the result of an introduction.
Booking
Conditions
Your contract is
with Pamela Drew t/a Sailing Jollies. When a complete and signed
booking form has been received by us with the relevant deposit, we
will issue a conformation invoice. A contract will exist once we
have issued the conformation invoice. It is your responsibility to
check the details on the conformation invoice and inform us of any
discrepancies immediately on receipt.
Payment of a
deposit means acceptance of our booking conditions both for yourself
and all members of your crew. The signatory on the booking form will
be responsible for the full cost of the holiday, including any
amendments or cancellation charges.
The contract is
governed by English Law and you agree to submit to the jurisdiction
of the English courts.
Payments
A 30% deposit of
the full holiday cost is required to confirm a booking. The balance
must be paid 12 weeks prior to the departure date. If the balance is
not paid by the due date we reserve the right to cancel the booking
and forfeit the deposit. If you book less than 12 weeks prior to the
departure date, the full amount is payable on booking.
Prices
Prices change all
the time and because of this we reserve the right to amend our
prices at any time prior to booking. However once a conformation
Invoice has been issued the price of your holiday will not be
increased unless we are required by law to charge a Government tax
or levy introduced or changed after your booking is made. This does
not apply to Invoice errors.
Cancellation of
bookings
If you cancel
your holiday the signatory must advise us in writing by post or fax.
A cancellation will be effective from the date received and the
following cancellation charges will apply:-
- More than 12
weeks prior to departure – Deposit
- Within 12 weeks
of departure 100% of the holiday cost
If one person
cancels he will not be refunded with his share of the yacht charter
if the others continue with the charter. Check with your travel
insurance if the cancellation falls within the terms and conditions
of the insurance , you can claim on the insurance .
Altering a
booking
We will try
wherever possible to accommodate you change of holiday request after
a booking. An administration cost might be payable. A major change
will be treated as a cancellation and re-booking. All names that you
gave us on the form must match the people on the holiday. You will
be liable for any charges which arises due to incorrect names being
advised to us at the time of booking.
Change or
cancellation of bookings by sailing Jollies
We will do our
utmost to provide the holiday you have booked but it is inevitable
that sometimes changes out of our control have to be made. Most of
these changes will be minor and we will inform you at the earliest
possible date. No Compensation is payable for minor changes. Major
changes of yacht to a smaller yacht type and/or cruising area, we
will do our utmost to offer you an acceptable alternative. If you do
accept the alternative we may have to cancel your holiday and you
will receive a full refund of all moneys paid. In all cases our
liability is limited to the amount of payment received by us and we
can not accept responsibility for any expense you may incur. We
cannot accept responsibility or pay compensation where we are forced
to change or cancel your holiday due to natural disasters and thing
out of our control ( war, riots, terrorist activity, nuclear
disasters, fire adverse weather conditions etc).
Our liability
We accept
responsibility for the proven acts of our staff, suppliers and local
agents whilst acting within the scope of their employment, except
where attributable to the fault of any member of your party, to an
unconnected third party or to any event which we or our supplier
could not without due care have foreseen . We cannot be responsible
for death, bodily injury or illness unless it has been proven to be
due to negligence of our staff suppliers or agents. Any compensation
shall be limited to the cost of your holiday except where death,
bodily injury or illness results. In the event of your yacht not
being available when you arrive at your destination for reasons
beyond our control i.e., damage or late arrival from previous clients,
we reserve the right to substitute a similar yacht or is one is not
available to provide hotel accommodation until such yacht becomes
available.
Chartering terms
The yachts are
offered for charter on conditions that the assigned skipper on the
booking form
